Action taken against late serving pizza shop

Papa John’s have been threatened with legal action by Brighton and Hove City Council after their takeaway on Preston Road was found to be serving pizza after the permitted closing time.

The pizza giant was ordered to close by 11pm from Monday to Sunday as a condition of planning, but staff have carried on serving food beyond this time.

The council has resorted to serving a breach of condition notice on Papa John’s and legal proceedings will follow if this is ignored.

The store is also in hot water for having installed a new shop front without planning permission and has until September 1st to submit a retrospective planning application.

Councillor Phelim MacCafferty, chair of planning, said: “When we attach conditions to planning applications we are careful to strike a balance between the needs of the business and the impact on residents living nearby. When these conditions are flouted we will not hesitate to take action.

“The same applies to the planning laws which are in place to protect the character of the area and ensure the safety of the public. I would strongly urge Papa John’s to take its responsibilities seriously, or face the consequences.”
